Family Educational Rights and Privacy Act (FERPA)
Rights Accorded to Parents or Students

Each year, Malone College is required to give notice of the various rights accorded to parents or students pursuant to the Family Education Rights and Privacy Act (``FERPA’’). Parents and students, under FERPA, have a right to be so notified and informed. In accordance with FERPA, you are notified of the following:

  1. Right to Prevent Disclosures
    You have the right to prevent disclosure of Education Records to third parties with certain limited exceptions. It is the intent of Malone College to limit the disclosure of information contained in your Education Records to those instances where prior written consent has been given for the disclosure, as an item of directory information of which you have not refused to permit disclosure, or under the provisions of FERPA which allow disclosure without prior written consent.
  2. Right to Inspect
    You have the right to review and inspect all of your Education Records maintained by or at Malone College.
  3. Right to Request Amendment
    You have the right to seek to have corrected any parts of any Education Record, which you believe to be inaccurate, misleading, or otherwise in violation of your FERPA rights. This right includes the right to a hearing to present evidence that the record should be changed if Malone College decides not to alter the Education Records according to your request.
  4. Right to Obtain Policy
    You have a right to obtain a copy of the written institutional policy adopted by Malone College in compliance with FERPA. A copy may be obtained in person or by mail from the Office of the Registrar located in Founder Hall.
  5. Right to File a Complaint within the FERPA Office
    You have the right to file a complaint with the Family Educational Rights and Privacy Act Office, at the Department of Education, 600 Independence Avenue, S.W., Washington, D.C. 20202-3887, (202) 260-3887, FAX: (202) 260-9001, concerning any belief that you have that Malone College has failed to comply with the provision of FERPA.

Release of Directory Information while at Malone College
The Family Educational Rights and Privacy Act of 1974 permits Malone College to release directory information about students. Directory (public) information includes the student's name, local (mailing) address, telephone listing, date of birth, major field of study, year of study (freshman, sophomore, junior, senior), participation in officially recognized activities and sports, the student's photograph, weight and height of members of athletic teams, dates of attendance, part-time/full-time status, degrees and awards received, and the most recent previous educational agency or institution attended by the student. If you do not wish to have your Directory information released by Malone College, you must notify the Registrar's office more than (10) days prior to the starting date of the semester or summer session for your request/instructions to be effective for that semester or summer session. Written requests must be presented to the Office of the Registrar located in Founders Hall and must be renewed annually.
